Voting and Your Employees

Voting is a privilege and a responsibility that every American is lucky enough to enjoy. It is important to protect the privilege and ensure that every citizen has the opportunity to participate in the process. California employers have a role in supporting the voting privilege, and have specific obligations related to the upcoming elections.
Employers are required to post the “Voters Bill of Rights” that includes information describing voting leave rights. The notice must be posted at least 10 days before every election. Employers are also required to provide employees with up to two hours of paid time off to vote if an employee does not have sufficient time outside of their working hours to vote. With the increase of voting by mail, there are likely fewer instances that must be accommodated, but employers should be cognizant of the obligation. Employees are not without their own obligations in order to receive this benefit. Employees must provide at least 2 days advance notice of their need for time away from work along with a copy of their voting receipt upon their return.
