New Paid Sick Leave Requirements for Small Employers in California Applies Retroactively

Governor Gavin Newsom signed SB 95 into law on Friday, March 19, 2021. You can read the text of the bill here. SB 95 provides supplemental paid sick leave benefits to employees needing to take leave for various reasons prompted by the COVID-19 pandemic and applies to private employers with more than 25 employees. Though passed on Friday March 20th, the benefits are retroactive back to January 01, 2021. This new law differs from previous COVID-19 supplemental sick leave policies that have existed on the federal, state, and local level, including new reasons for use and mandatory paystub reporting requirements.
